Can an attorney remove my mugshot and arrest record from being online?
Yes and no. For years we've focused on establishing direct communication with mugshot publishers and perfecting fast, affordable removal methods. The billable time an attorney would spend trying to accomplish what we already do efficiently generally isn't cost-effective — which is why many attorneys refer their own clients to us to remove their mugshot. My record was expunged, sealed, dismissed, or found not guilty. Doesn't the mugshot site have to remove it?
Usually not. Expungement applies to official government records — not private, for-profit mugshot sites. There's no federal statute requiring a publisher to remove or update a listing regardless of the case outcome, and a handful of sites that claim to honor expungement requests often ignore them in practice. Many mugshot sites also operate outside the U.S., where enforcing American law is difficult to impossible.
Isn't it extortion to pay to have my mugshot removed?
(We're not defending these sites — just explaining the current law.) No: extortion means obtaining something through force or threats. Publishers generally have the legal right to publish public arrest information; nobody is forcing or threatening you to pay for removal. Wanting your arrest record removed is a choice you're making, not a right the law currently guarantees you for free.
